The IP Court of Supreme Court of PRC was established on Jan. 1st, 2019
On January 1st, 2019, the IP Court of the Supreme Court of PRC was established in Beijing, China.
In accordance with Decision of the Standing Committee of the National People's Congress on Several Issues Concerning the Judicial Proceedings of Intellectual Property Cases Such as Patents implemented on Jan 1st, 2019, the parties dissatisfied with judgments and rulings of the first-instance on professional intellectual property civil cases such as invention patents, utility model patents, new plant varieties, integrated circuit layout designs, technical secrets, computer software, monopoly, etc.which was made after Jan. 1st, 2019, and filed an appealing, these appealing cases would be accepted and heard by the Supreme Court.
The parties dissatisfied with judgments and rulings of the first-instance on professional intellectual property administrative cases such as patents, new plant varieties, integrated circuit layout designs, technical secrets, computer software, monopoly , etc. which was made after Jan. 1st, 2019, and filed an appealing, these appealing cases would also be accepted and heard by the Supreme Court.
Where a party appeals to the IP Court of the Supreme Court of PRC, the appeal shall be submitted to the People's Court of the original trial say the Court of the First-Instance procedure.
